1. Agreement

These Terms of Use (the "Terms") constitute a binding agreement between you and Neurobit ("Neurobit", "we", "us", or "our") governing your access to and use of the Neurobit application and all related services, features, and interfaces (collectively, the "Service"). By registering an account or otherwise using the Service, you accept these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not accept these Terms, you must not use the Service.

2. Eligibility

The Service is intended for students enrolled in higher education. You represent that all registration and profile information you provide is accurate and current, and you undertake to maintain its accuracy. If you are under the age of eighteen (18), you may use the Service only with the consent of a parent or lawful guardian.

3. Account security

Your account is personal to you and is non-transferable. You are responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account. Credential sharing is prohibited, and the Service may enforce technical limits on concurrent account access. Suspected unauthorised use must be reported without undue delay to support@neurobit.in.

4. Educational purpose; no medical advice

The Service is an educational study aid provided solely for academic preparation. No content within the Service constitutes medical, clinical, diagnostic, or professional advice, and no content may be relied upon in connection with the care, diagnosis, or treatment of any person. You must at all times defer to your prescribed curriculum, your instructors, and authoritative clinical sources. While we endeavour to maintain accuracy, we make no representation or warranty that content is complete, current, or free from error.

5. Prohibited conduct

In connection with the Service, you shall not:

  • copy, reproduce, scrape, extract, resell, or redistribute Service content, in whole or in part, outside the Service;
  • share account credentials, or access or attempt to access the account or data of any other user;
  • probe, scan, disrupt, circumvent, or attempt to compromise the security or integrity of the Service or its infrastructure;
  • submit, upload, or share through the Service any material in which you do not hold the rights necessary for such use, including copyrighted textbook, publisher, or coaching material and examination papers or other confidential assessment material;
  • submit, upload, or share through the Service any content that identifies, or is capable of identifying, any patient or deceased person;
  • reproduce, redistribute, or make available outside the Service any material shared with you by another user of the Service;
  • misuse any reporting mechanism provided within the Service, including by submitting a report known to be false or made in bad faith;
  • use the Service in violation of applicable law or in infringement of the rights of any person.

We reserve the right to employ technical measures to detect and attribute unauthorised reproduction or redistribution of Service content.

6. Intellectual property

All study material, design elements, software, and other content comprising the Service are the property of Neurobit or its licensors and are protected by applicable intellectual-property laws. You are granted a limited, revocable, non-exclusive, non-transferable licence to access the Service for personal, non-commercial educational use only. No other right or licence is granted. Notices of claimed infringement may be submitted to support@neurobit.in and will be reviewed.

7. User submissions and shared content

The Service permits you to submit study materials of your own, including photographs and documents of your notes and flashcards authored by you, and may make available features permitting the sharing of curated study structures, designated categories of such materials, and selected flashcards with other users (collectively, "User Material"). This Section applies to all User Material and, in respect of sharing, applies where and to the extent sharing features are made available within the Service. You retain ownership of your User Material. You grant Neurobit a limited, non-exclusive, royalty-free, worldwide licence to host, store, reproduce, and display User Material solely to the extent necessary to operate the submission and sharing features of the Service, and for no other purpose. Sharing occurs only at your direction and upon your express consent, which may be withdrawn within the Service at any time.

Where flashcards are shared, a copy of the flashcards as they existed at the time of sharing is created in the account of each recipient who elects to receive them. Such copies are thereafter the material of the recipient. Withdrawal of sharing prevents the creation of further copies and does not delete copies already created. Recipients may not share onward any material received from another user.

You represent and warrant that all User Material you submit or share is your own work and that you hold all rights necessary to grant the licence set out above. You shall not submit or share User Material that comprises or contains: (a) copyrighted textbook, publisher, or coaching material, or any reproduction thereof; (b) examination papers or other confidential assessment material; (c) content identifying, or capable of identifying, any patient or deceased person; or (d) material that is otherwise unlawful, infringing, defamatory, obscene, or harmful.

User Material shared with you by another user is the work of the submitting user alone. Neurobit does not author, review, endorse, or verify User Material; such material is designated within the Service as not verified by Neurobit, and no representation or warranty is made as to its accuracy, completeness, lawfulness, or fitness for any purpose. Reliance upon User Material is at your own risk.

Where sharing features are made available, the Service provides a mechanism for reporting User Material believed to violate these Terms or applicable law, and reports so received are acknowledged within twenty-four (24) hours of receipt. We reserve the right, with or without prior notice, to remove or disable access to any User Material and to suspend or terminate the sharing privileges or the account of any user in accordance with Section 10. The account of any user determined to be a repeat infringer will be terminated. The knowing submission of a false or bad-faith report is itself a breach of these Terms. Notices of claimed infringement may additionally be submitted to support@neurobit.in in accordance with Section 6.

8. Modifications and availability

The Service comprises functionality available without charge and, in addition, an optional paid subscription ("Neurobit Plus"). Where a subscription is purchased, it is transacted, billed, and administered exclusively by the application marketplace from which the application was obtained, in accordance with that marketplace's terms; the applicable price, billing period, and renewal terms are disclosed prior to purchase, and cancellation and refund requests are administered by that marketplace. We may introduce, modify, suspend, or discontinue any feature of the Service at any time, and may amend these Terms from time to time. Material amendments will be reflected in the effective date above and, where appropriate, notified within the Service; continued use following the effective date of an amendment constitutes acceptance. We do not warrant that the Service will be uninterrupted, timely, or error-free.

9. Refunds and cancellation

Neurobit Plus is sold, billed, and administered exclusively by the application marketplace from which you obtained the application (as applicable, the Google Play Store or the Apple App Store). Neurobit does not itself process payments and cannot issue refunds directly. Accordingly:

  • you may cancel a subscription at any time through the subscription settings of the relevant marketplace account. Cancellation stops future renewals; access to Neurobit Plus continues until the end of the billing period already paid for, and the unused portion of that period is not separately refundable except where required by law;
  • all refund requests are handled by the marketplace in accordance with its published refund policy and applicable law;
  • deleting the application does not cancel a subscription; cancellation must be completed through the marketplace.

Where mandatory consumer-protection law confers a right of cancellation or refund that the marketplace does not otherwise provide, that right is not limited by these Terms.

10. Termination

You may discontinue use of the Service and delete your account at any time. We may suspend or terminate access to the Service, in whole or in part, where these Terms are breached or where reasonably necessary to protect the Service or its users. Deletion of your account and associated personal data is available as described in the Privacy Policy.

11. Disclaimers; limitation of liability

The Service is provided on an "as is" and "as available" basis without warranty of any kind, whether express, implied, or statutory, including without limitation any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the maximum extent permitted by applicable law, Neurobit shall not be liable for any indirect, incidental, special, consequential, or exemplary loss or damage, nor for any loss arising from reliance upon educational content, arising out of or in connection with your use of, or inability to use, the Service.

12. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in India.
